Conflicto de competencia suscitado entre el Juzgado Primero Laboral del Circuito de Pasto y el Juzgado Segundo Penal del Circuito Especializado de Popayán.
La controversia se generó en torno a las diferentes interpretaciones que hicieron los despachos judiciales involucrados del factor territorial.
Considera la Corte que el juzgado de la ciudad de Popayán es la única autoridad judicial con competencia territorial para conocer de la acción de tutela deprecada, por cuanto la vulneración alegada ocurrió allí.
Se dispone enviar el expediente al Juzgado Segundo Penal del Circuito Especializado de Popayán, para que de manera inmediata tramite y adopte la decisión de fondo a que haya lugar.
